ArbitrationandDisputeResolution

announcement,pointofsaledisplay,orpromotionalmaterialrelatingtotheTelevision;(iv)therelationshipsthatresultfromthiswarranty,(theforegoingclaims,disputescontroversiesanddisagreementsarecollectivelyreferredtoastheDispute),shallbereferredtoandresolvedbyfinalandbinding arbitration(totheexclusionofthecourts)Totheextentnotprecludedbylaw,youagreetowaiveanyrightthatyoumay
havetocommenceorparticipateinanyrepresentativeorclassproceeding againsttheRelatedPartiesrelatingtoanyDispute.Ifandwhereapplicableandtotheextentnotprecludedbylaw,youfurther

Arbitration

transportation,nuclearfacilitiesorsystemsoranyotherapplicationswhereTelevisionfailurecouldleadtoinjurytopersonsorlossoflifeorcatastrophic propertydamage.
IFTHECUSTOMERUSESTHETELEVISIONINANYCRITICALAPPLICATION,THECUSTOMER-ANDNOTTCl,ITSAFFiLIATES,ADRsORASPs-ASSUMESOLEANDFUllRESPONSIBILITYFORSUCHUSE.TClRESERVESTHERIGHTTOREFUSETOSERVICEANYTELEVISIONUSEDINACRITICALAPPLICATION.TCl,ITSAFFILIATES,ADRsANDASPsHEREBYDISCLAIMANYANDAllLIABILITY,DAMAGESANDCONSEQUENCESARISINGOUTOFTHESERVICEORREFUSALTOSERVICESUCHTELEVISIONANDFURTHERDISCLAIMANYANDAllLIABILITY,CONSEQUENCESANDDAMAGESTHATMAYARISEOR

GeneralProvisions
ifandtotheextentthatanyprovisionofthislimitedwarrantyshouldgenerallybefoundtobeunenforceable,theunenforceable provisionshall
beseveredfromthewarrantyanddeemednottoformpartofthewarranty.Theremainingprovisionsofthiswarrantyshallbeandremainvalidandenforceable.IfandtotheextentthatanyprovisionofthislimitedwarrantyasitrelatestoanyoftheRelatedPartiesisfoundtobeinvalidorunenforceableinrespectofthatparty(theExcludedParty)theExcludedPartyshallbedeemedtobeseveredorexcludedfromtheprovision,andtheprovisionshallremainvalidenforceableandapplicableinrespectoftheotherorremainingRelatedParties.
