orthedigitaltelevisionsoftwareinstalledontheDTV(theDTVSoftware)orany

youagreetobeboundbythetermsandconditionsofthisAgreement.IFYOUDO

a.Youmaynotshare,duplicate,republishorredistributetheSoftware; 
b.Youmaynotresell,rent,lease,sublicense,gift,loan,assignorotherwise 
transfertheSoftwareoranyofyourrightsunderthisAgreement; 
c.Youmaynotmodify,adapt,translate,reverseengineer,decompile, 
disassembleormakederivativeworksfromtheSoftwareorusethe 
Softwareincombinationwithanynon-Hitachisoftware;and 
d.YoumaynotusetheSoftwareforanycommercialpurpose. 
VIOLATIONS;INDEMNITY.Youunderstandandagreethatyouruseofthe 
SoftwareinanymannerexceptaspermittedunderthisAgreementcould 
constituteaseriouscrimeandcouldsubjectyoutodamagesandanawardto 
HITACHIofattorneysfeesinconnectionwithyourviolationofthisAgreement. 
Youfurtherunderstandthatyoumaybeheldlegallyresponsibleforany 
copyrightinfringementorotherviolationofintellectualpropertyrightscaused 
orfacilitatedbyyourfailuretoabidebythetermsofthisAgreement.Youagree 
todefend,indemnifyandholdHITACHIanditsparentandaffiliatecompanies

INTELLECTUALPROPERTY.TheSoftwareisprotectedbyfederalcopyright 
laws,internationalcopyrighttreatiesandotherintellectualpropertylawsand 
treaties.TheSoftwareislicensed,notsold,toyou.Allright,titleandinterest 
inandtotheSoftwareandanyintellectualpropertyassociatedtherewith, 
includinganyaccompanyingprintedmaterials,shallbelongtoHITACHIandits 
licensorsandsuppliers.Exceptasexpresslyprovidedherein,neitherHITACHI 
noranyofitslicensorsorsuppliersgrantstoyouunderthisAgreementany 
expressorimpliedrightinortoanypatents,copyrights,trademarks,trade

intellectualpropertyHITACHImayprovideinconnectiontherewithshallbe

LIMITATIONOFLIABILITY.Tothemaximumextentpermittedbyapplicable

anythirdpartiesforanydamagesofanynaturearisinginanywayfromthis 
agreement,youruseofthesoftwareorotherwise,whetherindirect,special, 
incidental,consequentialorotherwise,including,withoutlimitation,anyclaims 
forlostprofits,lostgoodwill,lostdata,businessinterruption,procurementof 
substitutegoodsorservices,orexpendituresmadeorcommittedforinreliance 
onthecontinuationofthisagreement,evenifadvisedinadvanceofthe 
possibilityofsuchdamages. 
8.NOFAILUREOFESSENTIALPURPOSE.YouagreethatneitherHITACHIS 
breachofthisagreementnoritsfailuretorepairadefect,errororbuginthe 
softwareshallconstituteafailureoftheessentialpurposeofthisagreement. 
g. CRYPTOGRAPHICSOFTWARE.Thesoftwarecontainssoftwaredeveloped 
bytheOpenSSLProject,includingcryptographicsoftwarewrittenbyericyoung 
(thecryptographicsoftware).Thecryptographicsoftwareisprovidedbythe 
OpenSSLProjectinasisconditionandanyexpressorimpliedwarranties, 
includingbutnotlimitedto,theimpliedwarrantiesofmerchantabilityandfitness 
foraparticularpurposeareherebyexpresslydisclaimedtothemaximum 
extentpermittedbylaw.InnoeventshalltheOpenSSLProject,itscontributors, 
HITACHIoranyofitsparentoraffiliatecompaniesbeliableforanydirect, 
indirect,incidental,special,exemplary,orconsequentialdamages(including, 
butnotlimitedto,procurementofsubstitutegoodsorservices;lossofuse, 
data,orprofits;orbusinessinterruption)howevercausedandonanytheory

10.TERMINATION.HITACHImayterminatethisAgreementimmediatelyatany 
timebyprovidingnoticetoyou.

GOVERNINGLAW;SEVERABILITY.ThisAgreementwillbegovernedbythe 
lawsoftheStateofNewYork,andyouconsenttotheexclusivejurisdiction 
andvenueinthefederalcourtssittingintheSouthernDistrictofNewYork, 
unlessnofederalsubjectmatterjurisdictionexists,inwhichcaseyouconsent 
totheexclusivejurisdictionandvenueintheBoroughofManhattan,NewYork, 
USA.

EXPORTRESTRICTIONS.HITACHIislicensingtheSoftwareforusewithin 
NorthAmericaonly.Youagreethatyouwillnotexportorre-exportthe 
Software.YouspecificallyagreenottoexportorreexporttheSoftware:(i)to 
anycountrytowhichtheU.S.hasembargoedorrestrictedtheexportofgoods 
orservices,whichcurrentlyinclude,butarenotnecessarilylimitedtoCuba, 
Iran,Libya,NorthKorea,SudanandSyria,ortoanynationalofanysuch 
country,whereverlocated,whointendstotransmitortransporttheSoftware 
backtosuchcountry;(ii)toanypersonorentitywhoyouknoworhavereason 
toknowwillutilizetheSoftwareinthedesign,development,orproduction 
ofnuclear,chemical,orbiologicalweapons;or(iii)toanypersonorentity
